Terms & Conditions
These Terms govern your access to and use of ColorFly.design, including its AI palette generation, editing, visualization, saving, sharing, and export features.
1. Operator and agreement
By creating an account or using ColorFly.design ("ColorFly", "we", "us", or "our"), you agree to these Terms and our Privacy Policy. Full operator details are available in the Contact section below.
2. Eligibility and accounts
You must be legally able to enter into a binding agreement and provide accurate account information. You are responsible for protecting your login credentials and for activity performed through your account. Notify us promptly if you believe your account has been accessed without authorization.
3. What the service provides
ColorFly.design helps users generate and refine strategic color palettes, assign color roles, review visual examples, compare palette versions, and export palette information. Features may vary by subscription plan. During beta, functionality may change as the product improves.
4. AI-generated results
Palette suggestions, names, descriptions, strategic guidance, accessibility notes, and other generated material may be produced with artificial intelligence. AI output can be inaccurate, incomplete, or unsuitable for a particular project. You are responsible for reviewing output before relying on it in a brand, website, product, accessibility decision, or client deliverable.
ColorFly.design does not provide legal, trademark, accessibility-certification, or professional design advice. Contrast tools are practical checks, not a guarantee of compliance with every applicable accessibility standard.
5. Your content and uploads
You retain your rights in prompts, uploaded images, logos, and other content you submit. You grant us a limited, non-exclusive license to host, process, transmit, and display that content only as reasonably necessary to provide, secure, and improve the service.
You must have the necessary rights and permissions for anything you upload. Do not upload confidential, sensitive, unlawful, or third-party material unless you are authorized to process it through the service.
6. Public, private, and shared palettes
Public palettes may appear in Color Inspirations, be viewed by other users, and be copied or adapted. Private palettes are available only where included in your plan. If you enable a private share link, anyone who receives that link may be able to view the shared palette until you disable the link. Treat private share links as confidential.
7. Acceptable use
You may not misuse the service, interfere with its operation, attempt unauthorized access, upload malicious content, evade usage limits, scrape the service at scale, infringe intellectual-property rights, or use the platform for unlawful, deceptive, or abusive activity.
8. Subscriptions, billing, and cancellation
Paid plans are billed monthly through Stripe. Prices, included AI actions, and plan features are shown on the Pricing page before checkout. Unless cancelled, subscriptions renew automatically at the applicable monthly price. You can manage cancellation through the billing portal. If you cancel, paid access generally continues until the end of the current billing period unless applicable law requires otherwise.
Fees are non-refundable except where required by law or expressly stated during checkout. We may change plans or prices prospectively with reasonable notice. Taxes may apply depending on your location.
9. Our intellectual property
The ColorFly.design name, product design, software, visual identity, and platform content are owned by us or our licensors. These Terms do not transfer ownership of the service or permit you to copy, resell, reverse engineer, or create derivative products from the platform except where applicable law does not allow that restriction.
10. Availability and termination
We aim to keep the service available but do not guarantee uninterrupted access. We may suspend or terminate access where reasonably necessary to protect the service, comply with law, address non-payment, or respond to a material breach of these Terms. You may stop using the service at any time.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We do not warrant that every output will be accurate, unique, error-free, or fit for a particular purpose.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the service. Nothing in these Terms excludes liability that cannot legally be excluded or limits your mandatory consumer rights.
12. Changes and governing law
We may update these Terms as the service evolves. Material changes will be communicated reasonably, and the effective date above will be updated. These Terms are governed by the laws of Romania, subject to any mandatory consumer-protection rules that apply to you.
Data transparency
Privacy Policy
This Privacy Policy explains what personal data ColorFly.design processes, why it is used, and the choices available to you.
1. Data controller
The data controller is Nobo Designs Agency SRL, operating ColorFly.design. Privacy questions and requests should be directed to contact@colorfly.design.
2. Personal data we process
- Account data: name, email address, encrypted password, verification status, and login-session information.
- Palette content: prompts, generated palettes, manual edits, palette versions, color roles, visibility settings, saved palettes, and private share-link settings.
- Uploaded content: inspiration images or logos submitted for palette generation.
- Subscription data: selected plan, subscription status, Stripe customer and subscription identifiers, billing-period dates, and payment-status events. We do not store full card details.
- Usage and security data: AI-action usage, palette views and copies, request timestamps, and technical information reasonably needed to operate and protect the service.
- Communications: messages and transactional-email delivery information when you contact us or receive service emails.
3. Why we use personal data

4. AI processing
Prompts, uploaded inspiration images, existing palette data, and requested edits may be transmitted to AI service providers to generate or revise palette results. Avoid including personal data, trade secrets, or confidential client information unless you are authorized and comfortable processing it this way.
5. Public palettes and sharing
If you make a palette public, its palette data may be displayed to visitors and other users. If you enable a private share link, the palette can be accessed by people who receive that link. You can disable sharing from the palette owner controls.
6. Service providers and recipients
We use trusted providers where needed to operate the service. These may include AI-processing providers, Stripe for subscription payments, Mailjet for transactional email, hosting and infrastructure providers, and professional advisers where necessary. Providers process data for defined purposes under their own contractual and legal obligations.
7. International transfers
Some providers may process data outside your country, including outside the European Economic Area. Where required, we will rely on appropriate safeguards such as adequacy decisions or contractual protections.
8. Retention
We keep personal data only for as long as reasonably necessary for the purposes described above, including providing your account, meeting legal obligations, resolving disputes, and protecting the service. Retention periods may vary by data type. You may delete your account from the account page, subject to records we must retain by law.
After account deletion, we retain a limited one-way keyed hash derived from the normalized account email address. We use this minimal record only to prevent repeated claims of free AI actions after account deletion and re-registration. It does not contain the deleted email address in readable form.
9. Your privacy rights
Depending on your location, you may have rights to request access, correction, deletion, restriction, portability, or objection to certain processing. You may also have the right to complain to your local data-protection authority. We may need to verify your identity before completing a request.
California residents may also have rights to know, correct, or delete certain personal information and to receive non-discriminatory treatment for exercising applicable privacy rights. ColorFly.design does not sell personal information.
10. Cookies and local storage
ColorFly.design uses essential cookies or similar storage technologies for login sessions, account security, remember-login functionality, and core product operation. These technologies are necessary to provide features you request.
With your permission, we also use Google Analytics cookies to understand visits and product usage so we can improve ColorFly.design. Analytics is optional and is not loaded until you select "Accept analytics." You can refuse analytics by selecting "Only essential" and change your choice later through the Cookie settings link in the footer.
11. Children
The service is not directed to children, and we do not knowingly collect personal data from children who cannot legally consent to the relevant processing. If you believe a child has provided personal data improperly, contact us so we can review and remove it where appropriate.
12. Security and changes
We use reasonable technical and organizational safeguards designed to protect personal data. No online service can guarantee absolute security. We may update this Privacy Policy as the product or legal requirements change, and we will revise the effective date when we do.
